Terms and conditions for Bueno Restoration LLC restoration and cleaning services.

TERMS OF USE

This Terms of Use Agreement (the “Agreement”) is made and entered into by and between you and Bueno Construction LLC, doing business as Bueno Restoration (the “Company”, “us”, “we”, or “our”). This Agreement sets forth the terms and conditions that govern your use of and access to the Website and any products, materials, and services provided by or on the Website (collectively, the “Services”).

SMS MESSAGING TERMS

Business Identity Clause

You are receiving messages from Bueno Restoration, a locally owned and operated restoration company in Cowlitz County, Washington. We are doing business as Bueno Restoration (DBA of Bueno Construction LLC). Messages you receive from us will include emergency response confirmations, service updates, appointment reminders, restoration progress notifications, and important information about your property damage restoration services.

Opt-Out & Support Mechanisms

You can cancel the SMS service at any time. Just text “STOP” to (360) 583-5826. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability Clause

Carriers are not liable for delayed or undelivered messages.

Message Frequency Clause

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages related to your service requests and updates. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Acceptance of this Agreement

Acceptance Through Using or Accessing the Services.

Please review the following terms carefully. By accessing or using the Services (or by clicking on “accept” or “agree” to this Agreement when prompted), you agree to be bound by the terms and conditions of this Agreement on behalf of yourself or the entity or organization that you represent. If you do not agree to the terms and conditions of this Agreement, you may not use or access the Services and must exit the Website immediately.

Account Responsibilities

Geographic Restrictions

The Company is based in the United States. By choosing to access the Services, you accept full responsibility for compliance with all local laws. The Company makes no representations that the Services or any of its content are accessible or appropriate outside of the United States.

Intellectual Property Rights

Ownership of Intellectual Property.

You acknowledge that all intellectual property rights, including copyrights, trademarks, trade secrets, and patents, in the Services and its contents, features, and functionality (collectively, the “Content”), are owned by the Company, its licensors, or other providers of such material. Neither this Agreement nor your access to the Services transfers to you any right, title, or interest in or to such intellectual property rights.

License to Use the Services.

The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use and access the Content in accordance with this Agreement. This license will terminate upon your cessation of use of the Services or at the termination of this Agreement.

All trademarks, logos, and service marks displayed on the Services are either the Company’s property or the property of third parties. You may not use such trademarks, logos, or service marks without the prior written consent of their respective owners.

Termination

No Warranty

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS. USE OF THE SERVICES IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, THE COMPANY AND ITS LICENSORS DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE, COMPLETE, OR CORRECT; THAT THE SERVICES WILL MEET YOUR REQUIREMENTS; THAT THE SERVICES WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED, OR ERROR-FREE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES, OR THEIR RESPECTIVE LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF USE, REVENUE, OR PROFIT, LOSS OF DATA, LOSS OF GOODWILL, OR DIMINUTION IN VALUE, OR FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGE WAS FORESEEABLE.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES IS TO STOP USING THE SERVICES.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates and their respective officers, directors, employees, agents, successors from any and all losses, claims, actions, suits, damages, liabilities, costs, or expenses of whatever kind, including reasonable attorneys’ fees, arising out of or relating to your breach of this Agreement or your use or misuse of the Services.

Disputes

Governing Law.

All matters relating to this Agreement are governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any conflict of law principles.

Dispute Resolution.

Any action or proceeding arising out of or related to this Agreement or the Services shall be brought only in a state or federal court located in Cowlitz County, Washington. You hereby irrevocably submit to the jurisdiction of these courts.

At the Company’s sole discretion, it may require any dispute arising out of or relating to this Agreement to be submitted to and decided by binding arbitration. The decision of the arbitrator shall be final and binding on the parties.

YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU MAY BE WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

Limitation to Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY WAIVED AND BARRED.

Miscellaneous

Severability.

If any term or provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such invalidity shall not affect any other term or provision of this Agreement.

Entire Agreement.

This Agreement, together with all documents referenced herein, constitutes the entire agreement between you and the Company with respect to the subject matter contained herein. This Agreement supersedes all prior and contemporaneous understandings, agreements, representations, and warranties.

Assignment.

You shall not assign or delegate any of your rights or obligations under this Agreement without the prior written consent of the Company. The Company may freely assign or delegate its rights and obligations under this Agreement at any time.
